Invitation for Bids - Lower D2 Ditch Flood Mitigation

The Lewis and Clark County Public Works Department is soliciting competitive bids from interested parties for the construction of the Lewis & Clark County – Lower D2 Ditch Flood Mitigation Project. The work generally consists of the installation of several precast concrete box culverts. Work items consist of but are not limited to:  clearing, grubbing, and topsoil stripping, installation of new precast concrete box culverts and their associated road crossing reconstruction, installation of culvert inlet and outlet protection (riprap), placement of salvaged topsoil, and revegetation of work areas. All precast materials were purchased separately and will be furnished to each site in coordination with the precast supplier.

All Bids must be in accordance with the contract documents on file at the Lewis and Clark County Public Works Office, 3402 Cooney Drive, Helena MT 59602. A cone of silence is established for this solicitation which prohibits any bidder, or entity with financial interest in the bid award, from communicating regarding the solicitation with any Lewis and Clark County elected official, employee, or agent other than the designated point of contact. A pre-bid conference will be held on Tuesday, September 10 at 10:00 a.m. local time in the Public Works Weed District Conference Room, located at 3402 Cooney Drive, Helena, Montana. Lewis and Clark County strongly urges interested bidders to attend.

Each bid or proposal must be accompanied by a Certified Check, Cashier’s Check or Bid Bond payable to Lewis and Clark County, in an amount not less than ten percent of the total amount of the bid.

Bids will be considered based on the most responsible bid submitted and the following criteria:  purchase price, product availability, and specifications.

Sealed bids must be received at the Office of the Board of County Commissioners, Room 345, City-County Building, 316 N. Park Avenue, Helena, MT 59623 no later than 4:00 p.m. local time on Wednesday, September 18. The envelope containing the sealed bid will be labeled with the bidder’s name, address, and “Lower D2 Ditch Flood Mitigation Project”.

Bids will be opened and read aloud at the public meeting of the County Commissioners on Thursday, September 19 at 9:00 a.m. local time in Room 330 of the City-County Building, 316 N. Park Avenue, Helena, MT.

This project is funded in whole or in part with a grant from the American Rescue Plan Act (ARPA). Award of the project will be contingent upon the Contractor providing or establishing a Unique Entity Identification (UEI) and passing a suspension and debarment verification per the requirements of the Funding Agency Special Provisions in this bid package and signing required certification forms.

All laborers and mechanics employed by the Contractor or Subcontractors in the performance of the construction work shall be paid wages at rates as required by Federal Davis Bacon Wage Rates. The Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin.

Successful Bidders shall furnish an approved Performance Bond and a Labor and Materials Payment Bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance, as required, shall be provided by the successful Bidder(s) and a certificate(s) of that insurance shall be provided.

The right is reserved to reject any or all proposals received, to waive informalities, to postpone the award of the contract for a period not to exceed sixty (60) days, and to accept the lowest responsive and responsible bid that is in the best interest of the Owner.

Lewis and Clark County reserves the right to reject any or all bids, to waive irregularities or to accept any bid deemed to be for the public good.
